GENERAL PROVISIONS
1.1 These general terms and conditions of sale (hereinafter, "General Conditions") apply to all sales of products (hereinafter, "Products" or "Product") purchased through the website www.letrecolonne.com (hereinafter "Site"). 1.2 The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter "Customers" or the "Customer"), understood as natural persons acting for purposes unrelated to their commercial, entrepreneurial, or professional activity, if any. 1.3 The language available for concluding the contract is Italian. 1.4 The Customer is required to carefully read the General Conditions which have been made available on the Site in a manner suitable to allow their storage and reproduction by the Customer. 1.5 Contracts concluded with Azienda Agricola LE TRE COLONNE di Salvatore Stallone (as identified below) through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, no. 206 (hereinafter also "Consumer Code"), by Legislative Decree 9 April 2003, no. 70 (hereinafter also "E-commerce Decree") and, where applicable, by R.D. 16.03.1942, no. 262 (hereinafter also "Civil Code"). 1.6 LE TRE COLONNE reserves the right to change the General Conditions of Sale by giving notice on this page of the site. The General Conditions of Sale applicable are those in force at the time an order is placed. Any changes will be effective after publication on the site.

All supporting information for purchasing should be understood as simple generic informational material, not referring to the actual characteristics of a single product.
PRICE
4.1 The prices of the products are inclusive of all taxes and duties except for customs duties and other charges that may be applied by the customs of the destination country. 4.2 All prices are expressed in Euro. 4.3 Shipping costs are borne by the customer, unless otherwise specified in promotions available on the shipping costs page
ORDER OF PRODUCTS
5.1 The essential characteristics and prices of the Products are indicated in the offer relating to each Product. 5.2 Orders from individuals who have not reached the age of majority will not be accepted. 5.3 To purchase the Products, the Customer must fill out and send the order form electronically online. If the Customer does not wish to register, they can still make a purchase: only the data necessary for delivery and any invoicing of an order will be requested. 5.4 The Customer must place the Product in the appropriate "cart," enter personal data, enter shipping data and, after having read the General Conditions, with particular reference to the contribution for delivery costs, the procedures for exercising the right of withdrawal and the Privacy Policy and provided confirmation of having read them, must select the desired payment method and choose the "Confirm order" option. 5.5 Before submitting their purchase order, the Customer will have the opportunity to correct any data entry errors by following the specific modification procedure contained on the Site. In particular, the Customer has the option to modify the quantity and type of Products they intend to purchase, by adding or removing one or more Products from the "cart." 5.6 By sending the order, the Customer acknowledges and declares that they have read all the information provided during the purchase procedure and fully accept the General Conditions. 5.7 LE TRE COLONNE reserves the right to evaluate the acceptance of received orders. LE TRE COLONNE will inform the Customer of any inability to accept received orders within 30 days from the day following the day on which the Customer submitted the order and will refund any amounts already paid by the Customer for the supply. 5.8 No contract shall be considered concluded between LE TRE COLONNE and the Customer if the company has valid reasons to believe that the Customer is not acting on the basis of an actual and genuine interest in purchasing the ordered products. In such cases, the order submitted by the Customer shall be considered ineffective. The sales office of LE TRE COLONNE will send the Customer, by e-mail, a communication certifying the non-conclusion of the Contract, also ensuring the cancellation of any charges and/or expenses to the Customer.
PAYMENT METHODS
6.1 The Customer may pay the price of the Products and the related delivery costs by:

- cash on delivery
- bank transfer
6.2 In the event that, for any reason, it is impossible to charge the amounts due from the Customer, the sales process is automatically cancelled and the sale automatically voided.
ORDER RECEIPT CONFIRMATION
7.1 Once an order has been received, the secretariat will automatically send an acknowledgment of receipt by e-mail, in which all the details of the order itself, the essential characteristics of the ordered product, its price, the amount paid, the existence of the right of withdrawal—with an indication of the timeframes and procedures for returning the goods—the geographical address for submitting any complaints, and information on after-sales services and existing commercial guarantees will be summarized. 7.2 Following receipt of an order, LE TRE COLONNE will verify the availability of the ordered product and the existence of other conditions for the sale, and only after such verification will it communicate its acceptance of the order and the shipment of the product. 7.3 In the event that LE TRE COLONNE is unable to fulfill a received order, it will promptly notify the Customer. 7.4 Any right of the customer to compensation for damages or indemnity, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance of an order, is excluded.
TRANSPORT AND DELIVERY
8.1 The Products purchased on the Site will be delivered to the address indicated by the Customer. The Customer may in any case request delivery of the products to a natural person of their choice. Deliveries will not be made to post office boxes. 8.2 For each order placed on the Site, LE TRE COLONNE issues an invoice or sales receipt for the goods shipped, sending it together with the package or also via e-mail. The information provided by the Customer at the time of the order will be used for issuing the invoice. No changes to the invoice will be possible after it has been issued. 8.3 The delivery costs of the goods are borne by the Customer and are clearly indicated on the Site and in the order form. 8.4 All purchases will be delivered by express courier TNT-SDA-FEDEX-UPS-MBE (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. LE TRE COLONNE is not responsible for unforeseeable delays. LE TRE COLONNE will send the Customer a confirmation e-mail once the Products have been shipped. In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products will be delivered within a period of 10 (ten) days, except for delays and in any case no later than 30 (thirty) days from the day following the day on which the Customer placed the order. 8.5 The delivery times indicated for the goods are indicative. 8.6 For the delivery of the goods, the presence of the Customer or their representative is required at the recipient's address indicated in the order. At the time of delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to that indicated in the delivery document and that the package is intact and not tampered with. Any damage to the package and/or Products or any discrepancy in the number of packages must be immediately reported by written reservation on the Courier's delivery receipt. Once the Courier's document has been signed, the Customer may not raise any objection regarding the external characteristics of the delivered package.
DUTIES AND RESTRICTIONS
9.1 LE TRE COLONNE is not responsible for any duties or purchase restrictions applied by the customs of the destination countries.
RIGHT OF WITHDRAWAL
10.1 Pursuant to the provisions of Legislative Decree 21 February 2014, n.21 implementing Directive 2011/83/EU on consumer rights, the Customer may return the purchased product and obtain a refund of the amount actually paid, without any penalty and without specifying the reason. 10.2 The right of withdrawal consists in the ability to return the purchased products to the seller and consequently obtain a refund of the purchase price of the products themselves. 10.3 The right of withdrawal may be exercised within 14 days of receiving the product in the following ways: 10.3.1 Before the expiry of the aforementioned period, the Customer must send a registered letter with return receipt to LE TRE COLONNE or present another declaration from which the intention to withdraw is explicitly evident. The communication may be sent, within the aforementioned period, by registered letter to the address Via XX Settembre 37/B – 70054 Giovinazzo (BA) or by e-mail to: info@letrecolonne.com. 10.3.2 The customer service, having verified the conditions for exercising the right of withdrawal, will contact the consumer in order to indicate the place where the products, intact, must be returned, within fourteen days, excluding holidays and weekends, from the date of communication of the withdrawal. 10.4 The costs of returning the purchased products are borne by the consumer. 10.5 If the value of the products has decreased due to handling other than that necessary to establish the nature, characteristics, and functioning of the products (by way of example: damaged products, not regularly or completely packaged, or missing or damaged parts, such as components, elements, accessories, packaging materials, boxes, documentation and/or other items), LE TRE COLONNE will refund the Customer the purchase amount minus the value of said decrease. 10.6 If the Customer returns products after the above deadline or in the case of products that have been opened and/or partially used and are not suitable for return, the right of withdrawal does not apply and LE TRE COLONNE will return the purchased goods to the Customer, charging the shipping costs to the Customer. 10.7 With the above limitations, LE TRE COLONNE will refund the amount actually paid by the Customer within 14 days of receiving the notice of withdrawal, by bank transfer.
NON-CONFORMITY DEFECTS, WARRANTY AND REPLACEMENT
11.1 The sale of Products other than food products is subject to the legal guarantees provided for in Articles 129, 130, and 132 of the Consumer Code. To benefit from the guarantee, the customer must keep the invoice or, if not available, the delivery note. 11.2 In case of non-conformity defects of Products sold by LE TRE COLONNE, the Customer must immediately contact Customer Service at the email address info@letrecolonne.com 11.3 The Customer is entitled to have the conformity of the goods restored free of charge by replacement, or to an appropriate reduction of the price or termination of the contract. 11.4 The Customer loses these rights if he does not report the lack of conformity to LE TRE COLONNE within two months from the date on which he discovered the defect. The action to assert defects not fraudulently concealed by LE TRE COLONNE is, in any case, time-barred within twenty-six months from the delivery of the goods. 11.5 If the purchased product is found to have been damaged during transport, the Customer may request its replacement within the mandatory period of 10 days from receipt. 11.6 The Product to be replaced must be sent, in normal condition, to the following address: Az Agr LE TRE COLONNE di Salvatore Stallone, S.p. 107 Km 0,200 – 70054 Giovinazzo (BA), Italy. 11.7 The fulfillment of the new order is subject to the availability of the requested Products.
ERRORS
12.1 The information relating to the Products provided on the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors. 12.2 LE TRE COLONNE reserves the right to correct errors, inaccuracies or omissions even after an order has been placed and also to change or update the information at any time without prior notice.
APPLICABLE LAW AND JURISDICTION
13.1 These General Conditions are governed by Italian law and must be interpreted in accordance with Italian laws. 13.2 For disputes arising from the interpretation, validity and/or execution of these General Conditions, the mandatory territorial jurisdiction will be that of the court of Bari.
